Overview


If your organization receives federal funding for R&D through SBIR/STTR programs, NIH, DOE, or other federal agencies, you are required to submit annual utilization reports in iEdison by January 31, 2026—or risk losing rights to federally funded inventions.


This requirement applies to any invention for which your organization elected title under the Bayh-Dole Act. Whether you're a university, non-profit, or small business, missing this deadline can trigger compliance flags, audits, or even government “march-in rights.”

What Is Utilization Reporting?

Under the Bayh-Dole Act and related federal regulations, once you elect title to an invention, you must:

  • Annually report on the commercial use or licensing status of the invention.

  • Submit this data via iEdison to the funding agency.

  • Continue reporting until the government determines the invention is no longer subject to active oversight.

This allows the government to evaluate how federally funded inventions are being commercialized for public benefit.


Who Must Report?

If you meet any of the following, you likely have a 2026 utilization reporting obligation:

  • You elected title to one or more subject inventions in iEdison.

  • You received SBIR/STTR Phase II or III funding.

  • You work in tech transfer, IP compliance, or federal grant management for a university, hospital, research institute, or small business.


How to Prepare for the January 31, 2026 Deadline

🔲 Confirm all inventions with elected title are listed in your iEdison account.

🔲 Gather licensing status, sales data (if applicable), and commercialization efforts.

🔲 Log into iEdison and update utilization reports for each invention.

🔲 Save confirmation receipts or submission IDs for audit support.

🔲 Conduct an internal review to catch missing or misfiled reports.

🔲 Engage with a compliance partner if behind or unsure how to proceed.
